Section 811 of the National Defense Authorization Act for Fiscal Year 2010 (Section 811) requires a justification and approval (J&A) for all direct awards within the 8(a) program equal to or greater than $20 million in value.  Although designed to simply ensure that taxpayer dollars are efficiently spent when the federal government buys goods and services, its implementation has not embraced this purpose, resulting in a devastating requirement that treats Native entities unfairly. The misunderstandings about Section 811 have resulted in unacceptable and unfair stereotypes of Native community-owned federal contractors and the purposes behind Native federal contracting that harms Native Americans across the country.
